On Oct 27, 1970 the Comprehensive Drug Abuse Prevention and Control Act was passed. Part II of this Act is the Controlled Substance Act which defined a classification system for drugs. It places most of the known hallucinogens in Schedule I. Included in this classification are LSD, psilocybin, psilocin, mescaline, peyote, cannabis and MDA. However, the Act did not explicitly include whole magic mushrooms.

Psilocybe cubensis is commonly collected throughout the tropics and subtropics.
