On Oct 27, 1970 the Comprehensive Drug Abuse Prevention and Control Act was passed. Part II of this Act is the Controlled Substance Act which described a scheduling system for drugs. It places most of the known hallucinogens in Schedule I. Included in this classification are LSD, psilocybin, psilocin, mescaline, peyote, cannabis and MDA. However, the Act did not specifically include whole magic mushrooms.

Psilocybin and psilocin are listed as Schedule I drugs under the United Nations 1971 Convention on Psychotropic Substances. Thus, the possession and use of Psilocybe mushrooms is therefore prohibited by extension.
