In the year 1978, the Florida Supreme Court ruled that possession of naturally occurring Psilocybe mushrooms is not illegal. However, the legality of knowingly gathering naturally occurring Psilocybe mushrooms for later use is still a gray area.

Psilocybe semilanceata makes its home on grassy meadows, particularly in wet, south-facing fields and other habitats well fertilized by animal dung, although unlike the magic mushroom Psilocybe cubensis it does not grow directly on the dung.
